Legality of link to FlashMe?

FlashMe is a rom-hack of a copyrighted Nintendo firmware. As I understand PH's copyright policy, links to rom-hacks on PH are permitted only if they are distributed as IPS or XOR. FlashMe, on the other hand, is distributed as an installer that contains the copyrighted firmware. How is linking to FlashMe any safer than, say, linking to copyrighted DS Download Play demos captured at E3? --Tepples 17:17, 1 June 2006 (EDT)
